Terms and Conditions

These are our terms and conditions for use of the network, which you may access in several ways, including but not limited to the World Wide Web via mironline.ca (the “MIR Site”), multimedia videos, mobile phone and RSS feeds. In these terms and conditions, “MIR” means the online student newspaper organization operated by the MIR staff. However you access MIR, you agree to be bound by these terms and conditions. Additional terms and conditions may also apply depending on where you access the MIR website.

1. Registration

You may access areas of the MIR Site that require registration by becoming a registered member. User accounts are only available to students of McGill University who agree to publish content on the site. You agree to be responsible for maintaining the confidentiality of your passwords or other account identifiers which you choose and all activities that occur under your account. User accounts may be created for external contributors as needed but they will not be given access to user-protected areas of the MIR Site.

2. Termination of registration

If you no longer wish to have a registered user account on the MIR Site, you may terminate your account by sending an email to mir@irsam.ca. The MIR holds sole discretion on the termination of user account access to our website, immediately without prior notice.

3. Use of material appearing on the MIR Site

Your use of the MIR Site is for your own personal and non-commercial use only. By using the MIR site, you agree that between MIR and you, except for user content and advertisements (as mentioned below), the MIR is the sole owner of all content on the MIR Site, which includes but is not limited to, all applicable copyrights, trademarks, logos, and other intellectual property rights thereto, as well as text, images, graphics, logos, audio, video and other material appearing on the MIR Site (hereafter noted as “MIR Content”). Images, audio, video, and other material on our site that is not MIR Content will have noted authorship and licenses.

You may download and print extracts from MIR Content for your own personal and non-commercial use only provided you maintain and abide by any author attribution, copyright or trademark notice or restriction in any material that you download or print. You may not use any MIR Content for any other purpose without our prior written approval. Unless expressly authorized by the MIR, you are not allowed to create a database in electronic or paper form comprising all or part of the material appearing on the MIR Site.

4. Disclaimer of liability

To the extent permitted at law, we do not accept any responsibility for any statement found in MIR Content. As a non-partisan student publication, MIR Content is not provided for any specific purpose or at any request of any particular group or individual. Instead, all content published by the MIR is the sole expressed opinion of the user. All text, images, graphics, video, audio, and other material that appear in any article published by a user on our website is the property and responsibility of the user. We will not be liable for any loss caused as a result of viewing, reading, or listening to MIR Content.

Our Service may contain links to external sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy and the terms and conditions of every site you visit. A link to an external site is not an endorsement of the views or opinions expressed in the link.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites, products or services.

5. Third-party advertising on the MIR Site

You may see advertising material submitted by third parties on the MIR Site. External individual advertisers are solely responsible for the content of their advertising material. the MIR accepts no responsibility for the content of advertising material, including, without limitation, any error, omission or inaccuracy therein. We do not advertise on content that uses materials that do not allow commercial use. Users are allowed to remove third-party advertising on any content they publish by informing MIR at their earliest convenience.

6. User content

Users of our site may be permitted to submit content for publication in various areas of the MIR Site. When the user submits content to us, the user agrees and represents that the user has created that content, or the user has received permission from, or are authorized by, the owner of any part of the content to submit it to the MIR Site. This may include text, images, graphics, logos, audio, video and other material appearing on the User-submitted content.

The user, as well as the owner of the content, still own all the copyright in the content sent to us, but by submitting content to us, the user is granting the MIR an unconditional, non-exclusive, irrevocable, fully transferable, royalty-free, perpetual worldwide licence to use, publish and/or transmit, and to authorize third parties to use, publish and/or transmit the user’s content in any format and on any platform, either now known or hereinafter invented.

Users acknowledge and agree that when they post content on the MIR Site or view content provided by others, they are doing so at their own discretion and risk, including any reliance on the accuracy, completeness, of that content. Users further acknowledge and agree that the views expressed by the user and other users in that content do not necessarily reflect the views of MIR, and the MIR does not support or endorse any user content. The user acknowledges that we have no obligation to pre-screen, monitor, review, or edit any content posted by the user and other users on the MIR Site.

The MIR, or authorized third parties, reserve the right to cut, crop, edit or refuse to publish, a user’s content at our or their sole discretion. We may remove the user’s content from use at any time.

The MIR accepts no liability in respect of any content submitted by users and published by the MIR or by authorized third parties.

The user warrants that the content they submit to the MIR is not obscene, threatening, harassing, libellous, deceptive, fraudulent, invasive of another’s privacy, offensive, defamatory of any person or illegal. The user warrants that the content they submit to us does not infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary or privacy rights of any party or individual. They agree not to (i) post content which is deliberately intended to upset or harm other users; (ii) use the MIR Site to post or otherwise transmit content that victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of any impermissible classification, which includes but is not limited to, religion, gender, sexual orientation, race, colour, creed, ethnicity, national origin, citizenship, age, marital status, military status or disability; (iii) post or otherwise transmit any content that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of the MIR Site or any computer software or hardware or telecommunications equipment; (iv) upload or otherwise transmit any content, or take any other actions with respect to the user’s use of the MIR Site, that would constitute, or would otherwise encourage, criminal conduct or give rise to civil liability; or (v) use the MIR Site for commercial purposes, including, without limitation, submitting any material to solicit funds or to promote, advertise or solicit the sale of any goods or services.

The user understands that the technical processing and transmission of the MIR Site may involve (i) transmissions over various networks; and (ii) changes to the content to conform and adapt to technical requirements of connecting networks or devices. The MIR assumes no responsibility for the deletion or failure to store postings of content or other information submitted by users to the MIR Site.

If you are under 16, you confirm that you have the permission from your parent or guardian to submit content.

7. Changes to these terms and conditions of use

Please note that the MIR may change these terms and conditions from time to time at our sole discretion and we reserve the right to do without your consent. Any revised terms and conditions will be applicable at the time of posting on the MIR Site. Please ensure that you review these terms and conditions regularly as you will be deemed to have accepted a variation if you continue to use the MIR Site after it has been posted.
